CUF Terms & Conditions

Release of Liability

1. Acceptance of Terms
By participating in any activities, field trips, or events at Cottonwood Urban Farm (CUF), you acknowledge and agree to these Terms and Conditions. Participation is entirely voluntary and at your own risk.

2. Assumption of Risk & Liability Waiver
By engaging in CUF activities, you assume all risks associated with participation, including but not limited to physical or psychological injury, illness, economic loss, or property damage. CUF and its affiliates, managers, members, agents, staff, and volunteers (collectively, "Releasees") are not liable for any injuries or damages incurred during participation.

3. Medical Treatment & Responsibility
Participants authorize CUF to provide emergency medical care if necessary and agree to be financially responsible for any associated costs. Participants should carry their own health insurance.

4. Participant Responsibility
Participants agree not to engage in activities unless they are physically able and properly trained.CUF reserves the right to deny participation if deemed unsafe for any individual.Any damage to CUF facilities or equipment caused by a participant due to negligence or reckless behavior will be the participant’s financial responsibility.

5. Indemnification
Participants agree to indemnify and hold CUF harmless from any claims, lawsuits, or damages, including legal fees, arising from their participation.

6. Governing Law
These Terms and Conditions are governed by the laws of the State of California. If any provision is found invalid or unenforceable, the remainder of this agreement shall remain in full effect.

7. Parental Consent for Minors
For participants under 18 years of age, a parent or legal guardian must provide written consent to these terms.By participating in any CUF activity, you affirm that you have read, understood, and voluntarily agreed to these Terms and Conditions.

Hold Harmless Agreement

By using the facilities at Cottonwood Urban Farm, all individuals and organizations ("Users") agree to the following terms:

1. Use of Property
Cottonwood Urban Farm permits Users to access its premises for workshops, classes, educational outreach, and related events. All activities must align with applicable laws and farm policies.

2. Liability Insurance
Users hosting events must obtain and maintain bodily injury liability insurance with a minimum coverage of $1,000,000. A certificate of insurance naming Cottonwood Urban Farm as an additional insured must be provided before any activities commence.

3. Indemnification & Hold Harmless
Users agree to indemnify, defend, and hold harmless Cottonwood Urban Farm, its officers, employees, agents, and affiliates from any claims, damages, losses, or expenses (including legal fees) arising from the use of the premises. This includes, but is not limited to, injuries or damages to persons or property.

4. Animals on Site
Users acknowledge the presence of honeybees, poultry, cats, dogs, and other animals on the premises. Any interaction with these animals is at the User’s own risk, and Cottonwood Urban Farm is not liable for any injuries or damages resulting from such interactions.

5. Compliance & Property Use
Users agree to utilize the premises responsibly and take necessary precautions to prevent property damage. Any damage caused by negligence or misuse will be the User’s financial responsibility.

6. Termination of Use
Cottonwood Urban Farm reserves the right to deny or revoke access to any User who fails to comply with this agreement. In cases of violation, immediate removal from the premises may be enforced.

7. General Provisions
Governing Law:
This Agreement is governed by the laws of California.
Entire Agreement: This document represents the complete agreement between Cottonwood Urban Farm and the User.
Amendments: Any modifications must be made in writing and signed by both parties.
Severability: If any provision is deemed invalid, the remaining terms remain in full effect.

By entering Cottonwood Urban Farm’s premises or hosting an event, Users acknowledge and accept these terms.
